I wanted to give you a further update since my last e-mail below.


First, the first meeting of the TCC will take place on Wednesday, May 21, 2008 at 6:30 PM in the County Administration Building in downtown Olathe as described below.

Second, I believe I have resolved the issues with those concerned about the language in the TCC ILA (version I) containing mention of "Land Use". At this time I believe 10 cities have approved the ILA (version I). If your community has not yet approved the ILA then you might consider approving either TCC ILA version I or TCC ILA version II, both are available on my web site: http://bocc.jocogov.org/dist2/taskforce.htm. TCC ILA version II is the same as version I except that the "land use" text has been removed from pages 2 (in two places) and 4 (in one place).

This change was requested by cities who believed the TCC could potentially and in the future result in intrusions into cities development decisions. I recognize the discussions I had related to the land use topic were outside of the process we invested in last summer and fall, but I think this action was necessary to move the TCC forward. In sum I do not believe this will hamstring the TCC in its discussions about transportation issues. If your city has approved the TCC ILA prior to this e-mail you need to take no action at this time.

Finally, at the first meeting of the TCC on Wednesday, May 21, 2008 we will discuss the amended ILA and also consider amending the ILA further so that it includes a voting system that in addition to requiring a simple majority vote for recommendations made by the TCC it will also consider the legal class of the cities. If you attended the TCC Charter meetings last year you will recall this is the "complicated" voting model I created that the group decided to remove because they felt it was too complicated for the limited authority of the TCC. Once I have the voting model language in the appropriate form or at least by May 14, 2008 I will send it to all cities and TCC members. It is my expectation, based on the discussions of the TCC charter committee, that the TCC will approve the amendments requested: removal of land use mentions and inclusion of majority and city class voting model. Assuming that the amendments to the ILA are accepted by the TCC the amended ILA (version III) will be sent to all TCC member cities and the county for consideration by their governing bodies. This means that all of us (cities and county) will need to approve an amended ILA to continue participating in the TCC. In the interim all TCC meetings that occur prior to August 1 or before all cities have approved the version III ILA will be conducted under version I or II of the ILA.

I hope this e-mail explains where we are at on the TCC and does not confuse. I want to acknowledge those cities who earnestly invested in participating in the TCC Charter meetings last year and apologize for any inconvenience this situation causes.

I look forward to having all 19 of Johnson County's cities sitting down with the county for the first time in an institutional framework to discuss transportation issues.
